If you have been arrest for a DWI, you may be worried about your DWI mugshot getting out into the papers and showing up on your file in the future.
Will My Fingerprints and DWI Mugshot Stay on File?
Oftentimes I get questions from clients whether it’d be parents for their children or anyone who has a job that is sensitive in terms of security or things of that nature or anybody in general regarding fingerprints and whether or not they will be returned to them. Section CPL 160.50 states that no fingerprints or mugshots shall be returned upon a conviction of 1192 offense. They will be on record permanently.
Worried Your DWI Mugshot Will Show Up in the Media?
I recently had a client who was arrested for DWI. He lived in a small town, and he asked me whether or not his case or any media coverage would be picked up regarding his arrest. I informed him that a lot of the local papers, a lot of towns have local bees, the Amherst Bee, the Lancaster Bee, or the Metro; they have reporters now who go to the police stations and really monitor these types of arrests, particularly DWI. You have Mothers Against Drunk Driving out there who take a very firm stand on this, so it’s extremely possible that somebody’s arrest could appear in one of these newspapers. It’s very important that that individual advise their attorney of their concern, where they work because it could have an impact on their employment.
