Buffalo DWI Lawyer Discusses Receiving Jail Time for an Arrest
As an experienced Buffalo DWI Lawyer I am consistently asked if one can go to jail for a DWI charge. If you’re charged and convicted with DWI in Buffalo, there are several factors that a sentencing judge will take into account when determining your sentence. One of those things that a sentencing judge has the ability to do is put an individual in jail. A lot of my clients, when they first sit in the chair, the first thing they ask me about before we even get into the facts of the case is, “Am I going to jail?”
My first response is, “I don’t know, and I will not know until I look at your previous record.” I look at your previous work history. I evaluate the facts of this particular case as to what happened. What I often do is a sentencing memorandum to the sentencing judge, where we sit down together, and we put together a biography of who my client is, and why my client should not go to jail, and all of the good and positive things that the individual has done in an effort to lead a good, law abiding life. Hopefully, they stay out of jail.
